Notice of Smartlinx’s and Bektek’s Biometric Information Collection, Storage, Use and Destruction Policy
This notice is intended to give you an overview of what kind of biometric information is being collected by Smartlinx Solutions, LLC, Bektek Enterprises, LLC, and/or their affiliates (collectively, “we”, “our” and “us”) on behalf of your employer, why it is being collected, how it is stored, used, and destroyed, as well as where you can find more information about this policy.
You are receiving this notice because you are a new or current employee of your employer and we have updated our existing policy. As a condition of your use of timeclocks and/or applications using biometric access that we provide, you must read, acknowledge, and give consent to the terms of the Smartlinx policy. By signing this notice or any other consent requested, you are providing your informed consent to us and your employer for collecting and using your biometric data as outlined in the policy. You will be notified in writing before any changes to this policy are implemented.
What is our specific purpose for collecting your biometric Information? We for ourselves and on behalf of your employer reserve the right to collect, use, and store, either internally or via a third party, your biometric information for the purposes of verifying your identity to be used for timekeeping and related timeclock application access purposes. By signing this notice, you consent to collection for these purposes by us and on behalf of your employer.
How will my biometric information be collected? Biometric information will be collected in the form of initial creation and storage of an algorithm key based on your fingerprint, palmprint, facial feature or iris scan (“your applicable scan”) that when used with our proprietary software is used to identify you on your employer’s timeclock or timeclock applications when you use your applicable scan to clock in at the beginning or end of your work shift or at break times.
How will my biometric information be stored and for how long? During the creation of the biometric algorithm key, your applicable scan information will be stored for the very short time required for the our software to create the algorithm key. Thereafter the biometric algorithm key will be stored by Smartlinx for a reasonable amount of time not to exceed one year from our most recent interaction with you in connection with your employer. Upon your employer notifying us that you have left your employment, we shall promptly follow your employer’s direction to destroy your biometric identifiers.
What is our policy on disclosing your biometric information to third parties? How will we dispose of your information once it is no longer needed? You consent to us disclosing and storing your biometric information to third parties who provide us with data storage for the services we provide. These data storage providers are subject to obligations to protect and use your biometric information only for purposes of us providing services to your employer. You also consent to us using your biometric information for third parties solely for disclosed business purposes (generally only in connection with the sale, transfer or other change of control of your employer to a new owner and operator of the timeclocks or timeclock applications used in connection with your employment by such new owner or operator) or when required by law. We acknowledge and confirm that your biometric information will be retained and destroyed according to the methods detailed above.
