AHCA Files Lawsuit Against Nursing Home Staffing Rule

On May 23, 2024 AHCA (the American Healthcare Association) filed a lawsuit in federal court to dismiss the Nursing Home Staffing Rule, originally released on April 22nd.  You can my analysis of the new Staffing Mandage here.

AHCA's steadfast support of the long-term care industry is unquestionable and we will continue to partner with AHCA to advocate for skilled nursing facilities nationwide.

While we agree with many of the complaints in this lawsuit, industry analysts remain skeptical that this lawsuit will stop the new staffing rule.  We urge our all nursing home facilities (including our 4,500+ customers) to continue to prepare for this new staffing minimum, which includes:

    • 3.48 hours of caregiver coverage per patient day (PPD)
    • .55 hours of RN coverage PPD
    • 24/7/365 RN presence in all facilities
